"After all, law is for man, and law is never helpless and particularly the Supreme Court, which is the repository of high powers and protector of life, shall not be rendered powerless."
This is Justice Kurian Joseph's famous last words when he delivered his dissenting opinion on Islamic jihadi terrorist Yakub Memon's stay of execution plea.
And while he may package it all he wants in bogus Christian values, his observation leaves much to be desired. He spoke and he may be heard and I hear him loud and well and not all who hear him are captive audience who are intimidated by contempt of court. So let me deconstruct Justice Kurian Joseph word for word. As he said, as Supreme Court he is powerful but that power must come with accountability - to the ordinary people of this country who are victims of terrorism.
The law Sir is not for man, even if you mean man to be generic for humans. In this country whose civilizational values do not derive from an anthropomorphic gawd, law is for mountains and rivers, dogs, cats, camels, cockroaches and cow not because of diredtive principles of the constitution but in this land we believe all creation has the same atma and is a manifestation of the divine where this manifestation is not arranged in any hierarchy.
Next - the law is not helpless is a meaningless statement because humans who implement the law, who are enjoined to enforce the law, who exort idiots like me to uphold the law are powerful not just helpless, but also corrupt, self-centered, hubris driven and publicity seeking.
Next - Supreme Court which is the repository of high powers and protector of life - the Supreme Court had no powers to stop Yakub Memon and his family and all other bastards who terrorised Mumbai and killed over 250 ordinary law abiding citizens of this country. Justice Kurian Joseph the Supreme Court has no powers Sir to stop terrorists but it does have the power to punish the terrorists in such an exemplary manner that at least some of these basdtards who kill defencelss men, women, and children and use even animals as suicide bombers may be deterred.
The Supreme Court is protector of life? Which life Justice Kurian Joseph and in which context have you made this observation? Protect Yakub Memon's life? You have set an ugly precedent Judge and insulted the families of the victims who died in 1993. You have also Sir forever compromised and undermined the State's determination to fight terrorists.
(Editor's note: Even Farooq Abdulla will disagree with you when you uphold a terrorist at the cost of the nation)
I can't help but wonder, considering you heard the petition of the rape victim minor who wanted to abort her child, where exactly are you coming from? I am reminded of that unfortunate Indian mother in Ireland who died because Roman Catholic Ireland does not allow abortion not even when the mother's life is at risk.
Two cases on the same day Justice Kurian Joseph and in both cases you have lectured to the country on the value of life. I repeat - which life? RR
